Terms and Conditions (T&C) for www.rottweiler-motors.com
1. Scope
These Terms and Conditions (T&C) apply to all orders and business relationships conducted through the online store at www.rottweiler-motors.com. They govern the contractual relationship between Rottweiler Motors and the customer (hereinafter "Customer"). By placing an order, the Customer agrees to these T&C.
2. Customer Base
The customers referred to in these T&C include both natural persons placing orders for personal purposes (consumers), as well as legal entities and partnerships placing orders for commercial, self-employed, or freelance purposes (business customers).
3. Contract Conclusion
The product presentation in the online store does not constitute a legally binding offer, but an invitation to place an order. By submitting an order, the Customer makes a binding offer to conclude a purchase contract. The contract is concluded when Rottweiler Motors accepts the order by sending an order confirmation via email or by delivering the goods.
4. Prices and Shipping Costs
The prices listed on www.rottweiler-motors.com are in Swiss Francs (CHF) and include the legal Value Added Tax (VAT). Shipping costs within Switzerland and Liechtenstein are included in the prices. For international shipments, additional shipping costs may apply and will be communicated to the Customer in advance.
5. Payment Terms
The Customer can choose between the following payment methods:
- Credit Card
- PayPal
- Purchase on Invoice (subject to review and approval by Rottweiler Motors)
For purchases on invoice, the invoice amount is due within 10 days of receipt of the goods. In the case of late payment, reminder fees and interest on arrears of 5% of the invoice amount will apply from the due date. Rottweiler Motors reserves the right to only process orders against advance payment.
6. Delivery Conditions
Delivery within Switzerland and Liechtenstein usually takes place within 1-2 business days after dispatch. If delays occur, the Customer will be informed immediately. If the delivery is delayed by more than two weeks, the Customer has the right to withdraw from the contract.
For international deliveries, individual delivery times apply, which will be communicated to the Customer in advance.
7. Retention of Title
The goods remain the property of Rottweiler Motors until full payment has been received.
8. Right of Withdrawal and Returns
The Customer has the right to return the received goods within 10 days without providing a reason. The goods must be unused and in their original packaging. The Customer bears the return shipping costs unless the goods were delivered incorrectly or are defective.
The refund of the purchase price will be processed within one week of receiving and inspecting the returned goods.
9. Warranty and Liability
The warranty is governed by statutory provisions. Rottweiler Motors is not liable for defects caused by improper handling, normal wear and tear, or external influences. Liability for slight negligence is excluded unless material contractual obligations are breached.
10. Data Protection
Rottweiler Motors treats the Customer's personal data confidentially and complies with applicable Swiss data protection laws. Personal data is used only for the purpose of contract fulfillment and to improve customer service.
11. Changes to the T&C
Rottweiler Motors reserves the right to change these T&C at any time. The version of the T&C valid at the time of the order will apply to the contract.
12. Applicable Law and Jurisdiction
Swiss law applies to all disputes arising from the contractual relationship, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zurich, Switzerland, unless mandatory legal provisions dictate otherwise.
